Where is my recipients’ data stored?

In the Netherlands.

How long do you keep addresses?

For as short a time as you like. The retention period is adjustable, with a minimum of 20 days; after that, personal data is anonymised. Want to change it? Just get in touch.

Do you enter into a data processing agreement?

Yes, with every customer whose customer data we process. You download it from your online account, fill it in and send it to us to sign.

What do you measure with the QR code?

Which card was scanned, and when. That shows you, recipient by recipient, who responded.

Can I use customer data for a card?

That depends on your relationship with the customer and your own privacy statement. If in doubt, talk to your privacy adviser.

Can I send a card to someone who has unsubscribed from my newsletter?

For an existing customer, usually yes. The email opt-in under the Dutch Telecommunications Act doesn’t apply to post, and unsubscribing from your newsletter relates to email. If someone objects to your advertising in general, or to receiving post, you stop. Mention in your privacy statement that you also contact customers by post.

And people who are not yet customers?

Stricter rules apply here. For consumers who aren’t customers, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) assumes consent is required, and you always check Postfilter (the Dutch opt-out register for addressed post) first: don’t send advertising mail to anyone listed in it. Advertising mail to consumers should refer to Postfilter. Post to business contacts falls outside Postfilter. If you’re unsure about your situation, talk to your privacy adviser.

Who can a recipient contact with a question about their data?

You. You’re the data controller and Lightr is the processor: we only process what you supply, and we help you with requests, such as deletion requests.

Who can I call with a privacy question?
